COMMITMENT TO YOUR PRIVACY

  • This website, http://www.devicescape.com and http://my.devicescape.com (collectively known as the “Devicescape Website”), and the Devicescape products and services (the “Devicescape Services”) are owned and operated by Devicescape Software Inc. (“Devicescape” or “We”). We understand you value your privacy. At Devicescape, we want to make your experience using the Devicescape Website and Devicescape Services satisfying and safe. This statement governs information you provide to us or we learn from your use of the Devicescape Website and the Devicescape Services and tells you how we may collect, use and, in some instances, share this information.

DEVICESCAPE INFORMATION COLLECTION AND USE

Devicescape gathers the following types of information about our users:

  • User-submitted information, including your name, user name, password, email address, information regarding your registered devices, and service provider / merchant names related to third- party accounts (for example: Wi-Fi hotspots, and web-based photo sharing services).
  • Personal information that you provide through optional, voluntary submissions to Devicescape (for example: through our online registration process and your emails to our customer service group). Personal information means any information that may be used to identify you, including, but not limited to, your home address and telephone number. The types and amount of personal information collected for these activities will vary depending on your activity.
  • Device usage tracking information, such as your location and usage data, gathered from wireless devices and personal computers that have been registered to use the Devicescape Service. This information is stored in our database and is associated with your registered user account. We describe this type of information collection in the “Usage Tracking” section of this document.

Devicescape gathers user information using the following processes

  • Optional Voluntary Personal Information Collection
  • We ask you for personal information (including, for example, your name) when you register with Devicescape. Throughout your use of the Devicescape Website and Services, you may complete your user profile by submitting additional personal information such as your mailing address, telephone number, credit card information, and other demographic information.

    The information we collect is used to personalize the Devicescape Services for you. For example, we may use your personal information to provide you with services which are based upon your geographic location.

  • Usage Tracking
  • We track product usage data to enable us to offer and improve the Devicescape Services to our users (“Usage Data”). This Usage Data is created when a device registered with the Devicescape Service attempts to log on to, or otherwise connect through the Devicescape Service to services such as a Wi-Fi hotspot or web-based e-commerce site. This Usage Data can consist of the name (SSID) of the Wi-Fi hotspot; location and identification of the hotspot; status and duration of the hotspot session; and whether a registered device is currently connected to an internet connection (presence information). This information is stored in our database and is associated with your registered user account. This information may be used to help improve site flow and usability, to discourage fraudulent use, and to make available the Devicescape Services including, without limitation, marketing-purposed communications.

  • Cookies
  • If your device has a browser, we may place a text file called a “cookie” in the browser files of your device. This cookie itself does not contain personal information, although it will enable us to relate your use of the Devicescape Services to information that you have specifically and knowingly provided. The only personal information a cookie can contain is information you had previously supplied to us. A cookie can’t read data off your hard disk or read cookie files created by other sites. We may use cookies to track user traffic patterns (as described above). In addition, we use encrypted cookies to authenticate you after you log onto the Devicescape Website. If you’ve set your browser to warn you before accepting cookies, you will receive the warning message with each cookie. You need to have cookies turned on to use the Devicescape Website.

  • UUIDs
  • When you register a device with the Devicescape Service, our software creates a universally unique identifier(“ UUID”), and stores this on the registered device. The UUID is used solely to associate the device with your Devicescape account, and is necessary for the Devicescape Service to function.

  • Children
  • Consistent with the federal Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requiring parental consent. Any person who provides their personal information to Devicescape represents that they are 13 years of age or older.

  • User Access
  • Users have access their personal information entered during the account registration process and may update their information at anytime on the Devicescape Website.

DEVICESCAPE TRANSFER AND INFORMATION SHARING POLICY

We may share personal information with our subsidiaries, affiliated companies, or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions, and in compliance with this Privacy Statement and any other appropriate confidentiality and security measures.

We may share personal information such as email addresses and Usage Data with third parties for their direct marketing purposes. The information sharing allows us to offer the Devicescape Service to you at no charge. At present, you may have the opportunity to opt-out of some of this marketing-purposed sharing when you register with Devicescape. In the future, it may be necessary for us to charge a fee if you choose to opt-out of marketing-purposed sharing or if you choose to obtain premium Devicescape Services. If we choose to charge such a fee, you will be given the option to discontinue the Devicescape Service.

We do not otherwise share personal information about our users with third parties unless doing so is appropriate to carry out a user’s request, to offer the Devicescape Service or, unless we reasonably believe that doing so is legally required or is in our interest to protect our property or other legal rights or the rights or property of others.

Finally, Devicescape may share aggregate information including, without limitation, personal information and Usage Data with third parties for marketing and other purposes. Aggregate information is not linked to individual users.

  • Merger or Bankruptcy

If we file for bankruptcy or have our assets sold to or merge with another entity, information we receive from you is a Devicescape asset and may be transferred.

INTERNATIONAL VISITORS AND CUSTOMERS

The Devicescape Website is hosted in the United States. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal information to the United States which does not have the same data protection laws as the EU, and that by providing your personal information you consent to:

  • the use of your personal information for the uses identified above in accordance with this Privacy Policy; and
  • the transfer of your personal information to the United States as indicated above.

SECURITY

No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems. We use secure server software (SSL) and firewalls to protect your information from unauthorized access, disclosure, alteration, or destruction. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software.

If we learn of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Devicescape Website or Devicescape Services or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Devicescape Website and the Devicescape Services. We may post a notice on the Devicescape Website if a security breach occurs. If this happens, you will need a web browser enabling you to view the Devicescape Website. We may also you send an email at the email address you have provided to us for these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive such free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should notify us at privacy@devicescape.com.

CHANGES AND UPDATES

We may occasionally update this Privacy Statement. When we do, we will also revise the “effective date” on the Privacy Statement. For changes to this Privacy Statement that may be materially less restrictive on our use or disclosure of personal information you have provided to us, we will attempt to obtain your consent before implementing the change. We encourage you to periodically review this Privacy Statement to stay informed about how we are protecting the personal information we collect. Your continued use of the Devicescape Services and Website constitutes your agreement to this Privacy Statement and any updates.
